1 Scope of Application

The General Terms and Conditions of Business (hereinafter referred to as "GTC") apply to all legal transactions concluded via the online shops www.schmuck-box.ch (hereinafter referred to as "SCHMUCKBOX"). The SCHMUCKBOX / schmuck-box.ch is operated by MUAU Schmuck (a brand of Eden Schmuck GmbH).

2 General

SCHMUCKBOX offers in the online shop schmuck-box.ch two jewellery subscriptions as well as a trial subscription / test product for personal use or as a gift. Consumers in the sense of these terms and conditions are natural persons who conclude the legal transaction for a purpose which cannot be attributed to their commercial or independent professional activity.

3 Order

3.1 The subscriptions of the SCHMUCKBOX are always subject to change and non-binding, unless otherwise stated in the offer. The ordered goods can differ slightly from the goods shown on the internet due to the technical possibilities of presentation, especially with regard to colour.

3.2 The products delivered as a subscription are not announced in advance, but are assembled and dispatched by our designers and employees from a careful product selection. The subscription recipient thus accepts each product from each individual delivery and cannot claim an exchange of the individual subscription / deliveries.

3.3 The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalogue. By clicking on the button "Buy" / "Order subject to payment", you place a binding order for the goods contained in the shopping basket.

3.4 The customer will be informed immediately about the receipt of the order. Confirmation of receipt of the order is sent together with acceptance of the order immediately after sending by an automated e-mail. With this e-mail confirmation the purchase contract is concluded.

3.5 The Customer is obliged to check and complete his contact and delivery data as well as the completion of the SCHMUCKBOX profile within 14 days after receipt of the order confirmation. The adjustments of the size information of the jewellery pieces in the profile will be taken into account up to 1 month before the dispatch of the next Circle / delivery date. Late deliveries will be taken into account in the following delivery.

3.6 The conclusion of the contract shall be subject to the reservation that in the event of incorrect or improper self-supply, we shall not or only partially perform.

This only applies in the event that the seller is not responsible for the non-delivery and the seller has concluded a concrete hedging transaction with the supplier with due care.

The Seller will make all reasonable efforts to procure the goods. Otherwise, the consideration will be refunded immediately. The customer will be informed immediately if the goods are not available or only partially available.

4 Retention of title

In the case of consumers, the seller reserves the right of ownership of the goods until the purchase price has been paid in full.

In the case of entrepreneurs, the seller retains title to the goods until all claims arising from an ongoing business relationship have been settled in full.

If the customer acts in breach of the contract, in particular in the event of default in payment, if the customer provides false information about his creditworthiness or if judicial composition proceedings or insolvency proceedings are opened against the customer's assets, the seller is entitled to withdraw from the contract and to demand the return of the goods, provided the customer has not yet or not completely provided the consideration.

The entrepreneur is entitled to resell the goods in the ordinary course of business. He hereby assigns to the Seller all claims in the amount of the invoice amount which accrue to him against a third party as a result of the resale. The seller accepts the assignment. After the assignment, the entrepreneur is authorised to collect the claim. The seller reserves the right to collect the claim himself as soon as the entrepreneur does not properly fulfil his payment obligations and is in default of payment.

The seller undertakes to release the securities to which he is entitled at the customer's request insofar as the realisable value of the seller's securities exceeds the claim to be secured by more than 10%. The selection of the securities to be released is the responsibility of the seller.

 

5 Payment and Shipping

You can pay either by Postfinance, Twint, MasterCard, Visa, Paypal or by invoice (through our partner Powerpay). SCHMUCKBOX assigns the respective claims to Powerpay. Thus the customer is supplied with the invoice directly by the partner Powerpay.

Unless otherwise agreed or unless otherwise stated in the item description, the shipment of the goods in case of payment in advance/bank transfer will only be effected when the invoice amount has been credited in full to the seller's account. For payment via PayPal, the customer must register at paypal.ch The terms of use of paypal.ch apply. Unless otherwise agreed or unless otherwise stated in the item description, the goods will be shipped as soon as the final amount is credited to the seller's PayPal account. The shipping costs are included in the subscription price.

 

6 Transfer of risk

The customer must inspect the delivered product(s) immediately upon receipt in order to determine whether the order has been fulfilled. In the event of any discrepancy, the Customer should not accept the package and should make a written note of any damage (e.g. evidence of counterfeiting, damaged product, missing products or items, or deviation from products ordered and/or from products listed in the shipping document) directly on the carrier's form. Please note that the risk of accidental loss or accidental damage - even during shipping - to the purchased item will be notified to the customer directly at the time of delivery of the item.

 

7 Right of withdrawal

You have the right to revoke this contract within 48 hours after ordering without giving reasons.

The revocation period is 2 days from the day on which you or a third party designated by you, who is not the carrier, took or has taken possession of the last goods.

In order to exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. You can use the attached model revocation form for this purpose, but this is not mandatory.

In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.
